1. The deal in plain English
daynight is a booking platform run by App Blender LLC. Tourists book activities and transport in Sharm El Sheikh; local operators run them. We charge the operator a service fee. We don't run the boats, drive the quads, mix the cocktails or pour the tea — the operator does.
We collect payment on behalf of the operator (via Tap Payments), pass it on, and step in if anything goes seriously wrong.
2. Agreeing to these terms
By creating an account, browsing daynighteg.com or installing the daynight app, you agree to these Terms, the Privacy Policy and the Cookies Notice. If you don't agree, please don't use the service.
3. Your account
- You must be at least 18, or have a guardian's consent.
- You're responsible for keeping your password and device secure.
- One person, one account. Don't impersonate anyone else.
- We can suspend accounts that violate these Terms or applicable law.
4. daynight is a marketplace
Each activity is listed by an independent operator (a “Vendor”). The contract for an activity, dive, dinner or ride is between you and the Vendor. daynight is not a party to that contract. We do, however:
- Vet vendors before listing them.
- Verify their licenses where local law requires one.
- Mediate disputes and refunds in accordance with these Terms.
- Step in to resolve service failures of last resort.
5. Bookings
When you tap “Book”, daynight makes a binding offer to the Vendor on your behalf. Your booking is confirmed when you receive an email and in-app confirmation. Until that point you can withdraw without charge.
The Vendor is responsible for the activity itself, including safety equipment, qualified staff, insurance and compliance with Egyptian Tourism Authority rules. daynight is not responsible for the quality of the activity beyond the screening and complaint mechanisms it offers.
6. Payment, refunds, chargebacks
Card payments are taken by Tap Payments Egypt on our behalf. We never see or store your card number — only a token and the last four digits, used for receipts and refunds.
- Prices include VAT where applicable.
- The currency shown at checkout is the currency you'll be charged.
- Refunds, when due, go back to the original card in 5–10 business days.
- If your card is fraudulently used, contact your bank — 3-D Secure protections apply.
7. Cancellation & no-show
Each listing shows its cancellation policy before you book. Typical defaults:
- Free cancellation up to 24 hours before start.
- Partial refund for cancellations within 24 hours.
- No refund for no-shows, unless the Vendor cancelled or failed to deliver.
- Acts of God (e.g. closed airspace, port closures): 100% refund.
8. Vendor terms
If you list activities on daynight, additional terms apply. By listing you confirm that you:
- Hold all required Egyptian licenses (Tourism Authority, etc.).
- Carry appropriate liability and accident insurance.
- Will deliver bookings as described, on time, with qualified staff.
- Will respond to messages within 24 hours.
- Authorise daynight to collect payment on your behalf and remit, less the agreed fee, within 48 hours of activity completion.
- Comply with the daynight Vendor Agreement signed at onboarding.
We may de-list any Vendor whose rating falls below 3.5 stars over 30 days, or who violates these Terms.
9. Content & intellectual property
The daynight name, logos, app, copy, code and original photography are protected by copyright and trademark law. You can use them for sharing bookings on social media; you can't pass them off as your own, re-sell access to the app, or scrape the catalogue.
Photos of activities are provided by the Vendor and licensed to daynight for promotional use. By submitting a review or photo you grant daynight a non-exclusive, worldwide, royalty-free licence to use it for the same purpose.
10. Acceptable use
You agree not to:
- Break Egyptian or international law while using daynight.
- Harass Vendors, drivers, or other users.
- Submit false reviews or fraudulent payment details.
- Reverse-engineer, scrape, or interfere with the service.
- Use the app for anything other than booking and managing real activities.
11. Apple & Google platform terms
When you install the app from Apple's App Store or Google Play, you also agree to those platforms' end-user terms. The platforms are not party to these Terms but you acknowledge that:
- Apple and Google are not responsible for the app or its content.
- Apple is a third-party beneficiary of these Terms with the right to enforce them against you.
- Refunds for in-app purchases follow each platform's own rules; out-of-app purchases (most bookings) are refunded by us via Tap.
12. Limitation of liability
To the maximum extent allowed by Egyptian law, daynight's total liability for any claim arising out of these Terms is capped at the total amount you paid through daynight in the 12 months before the claim. We are not liable for indirect, consequential, or punitive damages, including loss of enjoyment, missed connections, or weather.
Nothing in these Terms excludes liability that cannot legally be excluded — including for death, personal injury, fraud, or breach of the Egyptian Consumer Protection Law.
13. Governing law
These Terms are governed by the laws of the Arab Republic of Egypt. Any dispute that can't be resolved by good-faith discussion will be heard by the competent courts of Cairo, Egypt. Where consumer protection laws give you stronger rights in your home country, those rights are not affected.
14. Changes
We may update these Terms from time to time. Material changes will be announced in the app and by email at least 14 days before they take effect. Continued use after that date counts as acceptance.
